Canon 24 - Main Page

13.1 A Member or Past Member who has reached the Normal Pension Date , the Early Retirement Date, has become a Disabled Member or who has retired after the Normal Pension Date shall apply for a benefit as specified in these Regulations.

13.2 If the Committee receives evidence satisfactory to it that a person entitled to receive any benefit hereunder is physically or mentally incompetent to receive such benefit and to give a valid release therefor, or is a minor, and that another person or an institution is then maintaining or has custody of such person and that no tutor, curator, guardian, committee or other representatives of such person has been duly and legally appointed, the Committee may authorize payment of such benefit to such other person or institution, and the release of such other person or institution shall be a valid and complete discharge for the payment of such benefit.

13.3 Before becoming entitled to any benefit under this Plan the Member or other recipient thereof shall furnish the Committee with such information, as it shall require.

13.4 The nomination by a Member, Disabled Member, Past Member or Pensioner of any beneficiary to receive any death benefits payable under Sections 6.4 or 6.9 or an annuitant to receive a pension under Section 10.2 shall be made in writing in a form acceptable to the Committee and such nomination shall be considered to be valid only after due confirmation in writing from the Committee.

13.5 No Member or other recipient of benefit under the Plan shall have the right to alienate, encumber, assign or anticipate any of the benefits herein provided or any interest arising out of or created by this Plan. Any retirement income shall be incapable of surrender or commutation.

13.6 None of the benefits provided for herein shall be subject to the claim, or to execution, attachment, garnishment or other legal or equitable process by, any creditor of a Member or any other recipient of benefit under this Plan.

13.7 The legal Eligible Spouse shall be given precedence over any other person and the interpretation of these regulations shall never permit the payment of the survivor's benefit to more than one person as the result of any particular Member's death. The Pension Committee, at its discretion, may be guided by current provincial legislation in awarding benefits to a person in irregular union with the Member.
