14.1

  1. The provisions of this Plan may be amended at any time and from time to time by the Synod. However, no such amendment shall have the effect of diminishing the benefits accrued to each Member at the time such amendment comes into effect, consistent with the Fund then accumulated.

  2. Notwithstanding any other provisions of this Canon, or any other Canon, it is understood that the Committee, the Trustees and the Diocese, its officers and staff, shall not at any time act in a manner which is inconsistent with such regulations as may be established under the authority of the Income Tax Act (Canada), the Supplemental Pension Plans Act of Quebec (Bill 116) or any other laws which are, or may in the future be, applicable to the Plan.

  3. Notwithstanding Section 14.1(a), the Diocesan Council shall have the authority to approve, on the recommendation of the Pension Committee, any amendments to the provisions of this Plan which may from time to time be required to comply with appropriate laws, regulations or directives of regulatory authorities of competent jurisdiction.

  4. Where an amendment results in a certifiable past service pension adjustment (as defined under the Income Tax Act) in respect of a member, the amendment shall not apply to such Member prior to certification of the Past Service Pension Adjustment in accordance with the Income Tax Act.

14.2 The Plan may be discontinued at any time by the Synod, but only upon condition that such action shall render it impossible at any time for any part of the corpus of the trust or income thereon to be used for, or diverted to, purposes other than for the exclusive use of Members, Disabled Members, Pensioners, Past Members, Eligible Spouses or other recipients of benefits under the Plan.

14.3 The Diocese shall have no liability to make any payments to the Fund except as expressly provided in the Plan. Each Member, Disabled Member, Past Member, Pensioner or their heirs, executors, administrators or other personal representatives expressly releases the Committee, the Trustees, and the Diocese, its officers and staff, as they may be constituted at any time during the operation of the Plan, from any and all liability for any loss or damage whatsoever in connection with the Plan, except wilful misconduct.
